Terms of Service

1. Who we are
The CaptionCraft application and website (the "Service") are provided by Albert Yegon, trading as CaptionCraft ("we", "us", "our"). By creating an account, accessing, or using the Service, you ("you", "user") agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Eligibility and account
You must be at least 16 years old (or of legal age in your jurisdiction). You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it up to date.
3. The Service
CaptionCraft is a web application that lets you upload video and audio, generate transcriptions and captions, edit and style them, and export captioned video. Features available to you depend on your plan (Free, Creator, or Founding Member). We may add, change, or remove features over time.
4. Acceptable use
You agree not to misuse the Service. You must not:
- use the Service for any unlawful purpose, fraud, or spam;
- upload content you do not have the right to use, or that infringes any intellectual property, privacy, or publicity right;
- upload illegal content, including content that is defamatory, abusive, sexually exploitative of minors, or designed to harass others;
- attempt to interfere with the security or integrity of the Service (including probing, scanning, scraping, or introducing malware);
- reverse engineer, decompile, or attempt to extract source code, except where permitted by law;
- resell, redistribute, or sublicense the Service or circumvent any technical limit (including plan quotas or watermarking).
5. Your content
You retain all rights in the content you upload (videos, audio, transcripts, captions, templates). You grant us a limited, worldwide, non-exclusive licence to host, process, transmit, transcribe, transcode, and display your content solely to operate and improve the Service for you. You are responsible for your content, including verifying that you have the rights to upload and process it, and for any outputs you publish or share.
6. AI features and outputs
The Service uses third-party AI providers to generate transcriptions, captions, and style suggestions. Outputs may be inaccurate or incomplete. You are responsible for reviewing outputs before relying on or publishing them, and the Service should not be used as a substitute for professional advice in regulated contexts. We may apply content moderation and may refuse, filter, or remove outputs or content that violate these Terms.
7. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by Albert Yegon and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with your plan and these Terms. All rights not expressly granted are reserved.
8. Plans, payments, and billing
Pricing and plan details are shown on the Pricing page. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, invoicing, sales tax collection, subscription renewal, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms and Refund Policy, together with our Refund Policy.
Subscriptions: Creator subscriptions renew automatically each billing period until cancelled. You may cancel at any time; your paid features remain active until the end of the current billing period. Upgrades take effect immediately; downgrades take effect at the end of the current billing period.
Founding Member: the Founding Member purchase is a one-time payment that grants lifetime access to Creator-tier features as they exist from time to time.
9. Suspension and termination
We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and delete your account at any time. On termination, your right to use the Service ends. We may retain limited data as required by law.
10. Service availability
We aim to keep the Service available but do not guarantee uninterrupted, error-free, or fault-free operation. We may perform maintenance, change features, or impose reasonable usage limits.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service is limited to the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (such as for fraud, death, or personal injury caused by negligence).
13. Indemnity
You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of your content, your unlawful use of the Service, or your breach of these Terms.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated version and update the "Last updated" date. Material changes will be notified through the Service or by email. Continued use after changes means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of Albert Yegon's place of residence, without regard to its conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer law gives you the right to bring proceedings elsewhere.
